This Agreement is made between {educatorName} and the Arlington Public Schools (“APS”) (collectively “the Parties”).
WHEREAS, APS and the Arlington Education Association (“the Union”) are parties to a collective bargaining agreement (“the CBA”); and
WHEREAS, the CBA, Art. XVIII, Section A, provides for tuition reimbursement to teachers for qualifying courses, subject to several limitations and qualifications, and extends eligibility for this benefit to teachers without professional status during their second or third (or beyond) year of employment by APS; and
WHEREAS, the CBA, Art XVIII, Section A, provides that should such a teacher without professional status receive this benefit, the teacher must agree to remain employed by APS for a minimum of two (2) school years following the receipt of this benefit; and
WHEREAS the CBA, Art. XVIII, Section A, further provides that should the teacher without professional status voluntarily leave or resign from employment by APS during the two (2) year period, the teacher must repay to APS the amount of the benefit received; and
WHEREAS {educatorName} is a provisional teacher in year {number} of employment by APS;
Now therefore the Parties agree as follows:
1. The foregoing “Whereas” clauses are incorporated by reference as if set forth in full.
2. {educatorName} acknowledges and agrees that they are to receive tuition reimbursement benefit from APS pursuant to Art. XVIII, Section A, of the CBA.
3. In consideration of receiving the benefit referred to in paragraph 1, above, and for other good and valuable consideration, the receipt of which is hereby acknowledged, {educatorName} agrees to remain employed with APS for a minimum of two (2) school years following the receipt of this benefit, and, in the event that they voluntarily leave such employment before those two (2) school years, whether by resignation or otherwise, they agree to repay to APS the amount set forth in paragraph 1, above.
4. {educatorName} agrees that in order to comply with her repayment obligation set forth in paragraph 2, above, they shall enter into a repayment agreement mutually agreed upon between herself and APS that specifies the specific arrangements for such repayment.
5. {educatorName} further agrees that should they fail to comply with any of the obligations set forth in paragraphs 2 and 3, above, they consent to the entry by APS of a consent judgment in a Massachusetts court of competent jurisdiction against {educatorName} in the amount set forth in paragraph 1, above, or in the amount of any portion thereof which has not been repaid to APS.
6. {educatorName} acknowledges that they has entered into this Agreement knowingly, voluntarily, and of their own free will without duress of any kind.
